Expanded grounds for inspections during martial law

The Cabinet of Ministers of Ukraine has expanded the list of exceptional cases in which unscheduled inspections are permitted during martial law and broadened the areas subject to control, now including mineral resource management and land use


The Cabinet of Ministers of Ukraine amended Resolution No. 303 of March 13, 2022, which regulates the moratorium on state oversight and inspections during martial law. The new Resolution No. 121, adopted on January 28, 2026, maintains the general suspension of planned and unplanned inspections but significantly expands the circumstances under which authorities may conduct inspections.

Unscheduled inspections are now allowed: by court order; at the request of the business entity itself; to verify compliance with previous directives; in case of threats to human life or health, the environment, or national security; to fulfill Ukraine’s international obligations; or by the order of central executive authorities.

The scope of oversight has also been expanded. In addition to utilities, pharmaceuticals, food production, and education, it now covers geological exploration and mineral resource use, as well as land use and protection.

The Ukrainian Geological Survey is responsible for inspections in geological exploration and subsoil use, while the State Service of Geodesy, Cartography and Cadastre oversees land use and protection.

Decisions to conduct unscheduled inspections can now be made in the presence of threats or other exceptional grounds established by law, with central authorities required to be notified of the results within 15 days.
