MEMORANDUM
On Creation of the International Platform
‘The Implementation of the
Ukraine–European Union Association Agreement Standards
on the Effective and Balanced Use of Natural Resources’

General provisions

The International Platform ‘The Implementation of the Ukraine–European Union Association Agreement Standards on the Effective and Balanced Use of Natural Resources’ (hereinafter - the Platform) is realization of public-private partnership, mobilization of efforts of all stakeholders (state, business, science and education, as well as public) to ensure stable economic development of the state through implementation of the provisions of the Association Agreement between the European Union and its Member States, of the one part, and Ukraine, on the other part, and the relevant EU directives, in particular, on effective, balanced and sustainable use of natural resources and environmental protection.

The platform will contribute to modernization and intensification of innovative development of the relevant sectors of economy, their proper technological support, increase of the level of energy and resource saving, compliance with environmental safety requirements in the course of conduct of economic activity.

This Platform is solely a form of cooperation between its members within the purpose and objectives of its creation and is not an association of enterprises.

Purpose and main objectives of the Platform

The purpose of the Platform is to increase efficiency and competitiveness of the Ukrainian economy by introducing mechanisms and practices provided for by the relevant European legislative acts in the context of implementation of the provisions of the Association Agreement between Ukraine, on the one part, and the European Union, the European Atomic Energy Community and their Member States, on the other part. The existing production infrastructure, technological base and their information support in Ukraine mostly do not meet the current requirements of economic development disable competitiveness of domestic products and services in the world market. That is why the activity of the Platform is aimed primarily at facilitating entry of the national manufacturer into international markets; bringing quality of domestic products and services in line with European standards by re-equipment of production and improvement of technological processes in accordance with the EU regulations and norms; to achieve leading positions on efficient, balanced and sustainable use of natural resources.

Main areas of activity of the Platform:

  • implementation of structural reforms to increase the effectiveness of managerial decisions;
  • introduction of environmentally friendly methods of improving the efficiency of production and services, the level of energy and resource saving, reducing the negative impact of economic and other activities in certain sectors of the economy on environment and human health;
  • development and implementation of the latest competitive technologies, equipment, devices and equipment;
  • improvement of methods of prospecting, exploration and development of mineral deposits;
  • development of a modern geoinformational and analytical system for environmental monitoring, integrated into the international observation network, etc.

Fundamentals and principles of the activity of the Platform

The activity of the Platform is based on the principles of voluntariness, free cooperation, uniting efforts of interested participants and concentrating their capabilities on resolution of specific tasks.

The activity of the Platform is based on the principles of priority of state interests and development of domestic business, orientation on attraction of the latest technologies in production, expansion of cooperation and search of the best participants, transparency of rules of participation and publicity Platform efficiency.

The platform provides for preparation of scientific and technological initiatives and recommendations to governmental authorities, scientific community, business for solving pressing problems, including by means of inclusion of specific projects in existing investment programs, as well as initiation of research and technological development at the national or international levels.

Organizational structure of the Platform

The main documents governing the activities of the Platform are the Memorandum on Creation of the Platform and the Regulations on the Platform, together with all the annexes being integral parts thereof.

The highest management body of the Platform is the General Meeting of the Platform Members (hereinafter - the General Meeting).

The Supervisory Board is elected at the General Meeting to represent the interests of the Platform participants, to ensure transparency and to provide expert and analytical support for their activities.

The Supervisory Board evaluates effectiveness and efficiency of the Platform's activities and carries out supervision over compliance with the legal requirements.

The main tasks of the Supervisory Board are set out in the appropriate Regulation on it.

Ongoing coordination, cooperation and interaction within the Platform is ensured by the Operating Company.

Procedure for joining the Platform

On November 15, 2017, at the extraordinary congress of the Public Organization Ukrainian Association of Geologists, it was decided to create the Platform ‘The Implementation of the Ukraine–European Union Association Agreement Standards on the Effective and Balanced Use of Natural Resources’.

On December 7, 2017, at the VI Congress of Geologists of Ukraine, the purpose, objectives, main areas of activity, structure and constituent documents of the Platform were announced and the interested parties were invited to join the said Platform by filing a corresponding application.

Platform participants

The participants of the International Platform are legal entities and individuals - participants of the Platform projects for the period of implementation of such projects.

A legal or physical entity acquires the status of a participant of the Platform from the date of entry into force of such agreement.

The status of the Platform participant in no way deprives the relevant person of its economic and financial independence and does not put its own financial and economic activity in dependence on others - either participants and/or decisions of the management bodies of the Platform.

Final provisions

Disputes arising out of interpretation or application of this Memorandum shall be resolved by means of consultations and negotiations.
